8. Contact forms and enquiries

When you contact Fitness in the Park through our website, we may collect information including your name, telephone number, email address, subject and the contents of your message.

We use this information to respond to your enquiry and, where appropriate, to provide information about our services or establish a client relationship with you.

Our contact form is processed by a Cloudflare Worker. After validation and spam checks, your name, email address, optional telephone number, subject and message are sent through Resend to our enquiry mailbox. Your email address is used as the reply address. Resend and our email providers process message contents and delivery information to deliver and manage the enquiry.

The website does not maintain a separate contact-submission database. Enquiries remain in our email systems and may be retained in provider delivery records under their settings. Cloudflare Turnstile checks the submission for automated abuse; the check includes your IP address and a security token. We do not deliberately send the contents of your enquiry to Google Analytics.

Please avoid including unnecessary sensitive information in a general website enquiry. Where detailed health, disability or other sensitive information is required, we may arrange a more appropriate method for providing it.

9. Website information and cookies

Our website uses Cloudflare for hosting, delivery and security, including Turnstile to help protect our enquiry form. Cloudflare processes technical request and security information, such as IP addresses and browser information, to deliver and protect these services. See Cloudflare’s privacy policy.

When enabled on our production website, Google Analytics 4 helps us understand page visits and usage. It uses cookies to distinguish visits and collects information such as pages viewed, browser and device details, session activity and approximate location. Our analytics tag disables Google signals and advertising personalisation. We do not deliberately send names, email addresses, enquiry messages or health information to Analytics. See Google’s privacy policy.

Google Analytics is enabled only on our production website at https://fitnessinthepark.com.au. It is not loaded by staging or development builds.

PTminder and Instagram embeds may use their own cookies or similar technologies when their content loads or you interact with it. Cookies are small pieces of information stored on your device. You can also block or delete cookies through your browser, although this may affect bookings and other embedded functionality.

10. Third-party services

Fitness in the Park uses third-party services to help operate our website and provide our services.

These may include:

• PTminder and Xplor for client, booking and service management;
• payment providers integrated with PTminder or otherwise used by Fitness in the Park;
• Cloudflare for website hosting, delivery, request processing and Turnstile spam protection;
• Resend and our mailbox providers for enquiry email delivery and correspondence;
• Google Analytics for website usage measurement when enabled;
• Meta platforms for Instagram content embedded on our website; and
• other technology providers required to operate our business.

We provide personal information to third-party service providers only where reasonably necessary for them to provide their services or where otherwise permitted by law.

Third-party services operate under their own terms, privacy policies and security practices.

11. Facebook, Instagram and other external services

Our website contains links to Fitness in the Park’s social media profiles, including Facebook and Instagram.

If you follow a link to, communicate with us through, or interact with content on a third-party platform, that platform may collect information about you independently of Fitness in the Park.

The collection and handling of information by those services is governed by their own privacy policies.

Our website may also contain links to other third-party websites. Fitness in the Park is not responsible for the privacy practices of external websites or services.

12. Disclosure of personal information

• government, regulatory or law enforcement authorities where required or authorised by law; or
• another person or organisation where you have consented to the disclosure.

We take reasonable steps to limit disclosure to information relevant to the purpose for which it is being disclosed.

13. Overseas processing and storage

Some technology and service providers used by Fitness in the Park may use systems, infrastructure, personnel or subprocessors located outside Australia.

As a result, personal information may in some circumstances be processed, stored or accessed from overseas.

The countries involved may vary according to the service provider and the systems used to provide their services. Our website uses international providers including Cloudflare, Google, Resend, Meta and PTminder/Xplor. We do not represent that all information remains in Australia. Provider privacy information describes their processing practices; see also Resend’s privacy policy.

Where Australian privacy law applies to an overseas disclosure of personal information, Fitness in the Park will take reasonable steps to comply with applicable requirements relating to that disclosure.

14. Security

Fitness in the Park takes reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

These measures may include appropriate physical, technical and administrative safeguards, access controls, secure systems, encrypted connections, authentication controls and the use of reputable service providers.

No method of electronic transmission or storage can be guaranteed to be completely secure.

If we become aware of a data breach involving personal information, we will assess and respond to the incident and make any notifications required by applicable law.

When personal information is no longer reasonably required, we will take reasonable steps to securely destroy or de-identify it, unless we are required or permitted to retain it.

16. Accessing and correcting your personal information

You may request access to personal information Fitness in the Park holds about you or ask us to correct information that you believe is inaccurate, incomplete, out of date, irrelevant or misleading.

You can contact us at:

Email: info@fitnessinthepark.com.au

You may also be able to review or update certain information directly through your Fitness in the Park client account.

We may need to verify your identity before providing access to or changing personal information.

There may be circumstances where we are permitted or required by law to refuse access to certain information. Where appropriate, we will explain the reason for doing so.

17. Marketing communications

We may send you information about Fitness in the Park services where you have requested or consented to receive those communications, or where otherwise permitted by law.

You may opt out of marketing communications at any time by using an unsubscribe facility provided in the communication or by contacting us.

Opting out of marketing does not prevent us from sending communications reasonably necessary to provide services to you, such as booking confirmations, reminders, account notices or important changes to a service.

18. Children and people requiring assistance

Some Fitness in the Park services may be provided to children or people who require assistance managing their services or personal information.

Where appropriate, we may communicate with or obtain information from an authorised parent, guardian, nominee, carer, support coordinator or other representative.

We will take reasonable steps to ensure that personal information is handled appropriately having regard to the circumstances of the individual and the service being provided.

19. Privacy enquiries and complaints

If you have a question, request or complaint regarding privacy or the way Fitness in the Park has handled your personal information, please contact us:

Fitness in the Park

Please provide sufficient information for us to understand and investigate your concern.

We will consider privacy complaints and endeavour to respond within a reasonable period.

If the Privacy Act 1988 applies to your complaint and you are not satisfied with our response, you may also be able to make a complaint to the Office of the Australian Information Commissioner.

20. Changes to this Privacy Policy
